Foilport is a service of 15507120 Canada Inc., a Canadian Corporation. These terms explain the rules for using our website, private digital binders, photo-based condition tools, and market references. In these terms, “Foilport,” “we,” “us,” and “our” mean that corporation.
1. Your agreement
Please read these terms before creating an account or using Foilport’s interactive tools. By agreeing to these terms, you enter into an agreement with 15507120 Canada Inc. If you do not agree, do not create an account or use those tools. Our Privacy Policy separately explains how we handle personal information; agreeing to these terms does not waive your privacy rights.
You must be legally able to enter this agreement. If you use Foilport for another person or organization, you must have authority to do so. Where parental or guardian authorization is required by applicable law, it must be obtained before using the service.
2. The free Pokémon beta and your account
The current beta supports English and Japanese Pokémon cards and USD market references. It offers private collection records, named binders, guided photo checks, and available pricing information. It does not offer card custody, a marketplace, public binder sharing, payments, or a professional grading service.
Registration does not guarantee access. A verified sign-in identity, verified email address, and current owner approval are required for interactive card tools. We may decline, suspend, or revoke beta access to manage capacity, protect people or data, address misuse, or comply with law. Revocation alone does not delete your records; the Privacy Policy explains deletion and how to contact us.
Provide accurate account information, protect your sign-in credentials, and tell us promptly if you suspect unauthorized access. Do not share an account to bypass approval or use someone else’s identity. You are responsible for activity you authorize through your account, subject to applicable law.
The beta is currently free. There is no promise of unlimited storage, a fixed assessment allowance, permanent free access, or uninterrupted processing. Any future paid service would require separate, clearly disclosed pricing and terms before a charge; these terms do not authorize a payment.
3. Photo estimates are not certification
Card identification, overall condition estimates, and centering, corners, edges, and surface diagnostics may be produced with artificial intelligence. They can be incomplete or wrong. Lighting, resolution, glare, altered images, and hidden damage affect what photos can show. We may decline a check or request new photos rather than provide a score.
An estimated grade is not a PSA-issued grade, official PSA subgrade, authenticity determination, guarantee of a grading outcome, or professional appraisal. Diagnostic scores are photo-based estimates and are not an averaging formula for the overall estimate. A raw card’s condition, an AI estimate, and an actual slab grade are separate facts.
Confirm the card’s exact identity and printing yourself. Obtain an in-person inspection or an appropriate professional service when authenticity, condition, insurance, or a transaction depends on it. You remain responsible for decisions about buying, selling, insuring, storing, or submitting a card for grading.
Public demos and results labelled sample or fixture are illustrative. They are not analysis of your card, real-time provider output, or evidence of prediction accuracy.
4. Market references and collection totals
Prices are available third-party references for supported exact variants, languages, printings, and conditions. They are not offers to buy or sell, executable quotes, financial or investment advice, guaranteed proceeds, or a promise that any buyer or insurer will accept a value. Prices may be missing, delayed, stale, or incorrect; check the stated source and retrieval date.
An estimated grade does not turn a raw card into a graded-card value. Graded references remain unavailable where supported coverage is absent. Unknown values are not zero, and a total with unpriced cards is incomplete. Any hypothetical grading outcome must be treated separately from the current raw-card reference and does not guarantee profit after fees or other costs.
One physical card can belong to several binders without being counted several times in the overall collection. Your entries describe your collection; Foilport does not independently verify ownership, quantity, slab labels, purchase amounts, or user-entered condition.
5. Your photos, notes, and records
You retain the rights you hold in your photos, notes, and other content. Upload only content you are entitled to provide and that we may process for the requested service. Do not upload other people’s personal information without a lawful basis, or unnecessary sensitive information, faces, addresses, payment details, or passwords.
You give us a limited, non-exclusive permission to host, copy, resize, re-encode, display privately to you, and process your content, and to use service providers for those purposes, as needed to operate Foilport and carry out your requests. Requested live photo checks include sending the necessary card images and identity details to our AI provider. This permission does not authorize publishing your private collection, selling your photos, or using them to train our own models.
Saved assessment inputs and results are kept as the evidence for that particular check. Replacing a display photo or correcting a saved card’s identity does not rewrite the original assessment. A new check creates a separate result. You can delete a physical card or your account under the controls and retention rules in the Privacy Policy.
Keep your own copies of important photos and records. Foilport is a collection tool, not an archival or backup guarantee. Unsaved checks and unreferenced uploads expire as described in the Privacy Policy.
6. Acceptable use
Use Foilport lawfully and respect other collectors, rights holders, and our service providers. Do not:
- Access another person’s account, cards, photos, or notes; circumvent approval, ownership checks, security controls, rate limits, or spending safeguards.
- Upload unlawful, infringing, deceptive, malicious, or abusive content; impersonate another person; or interfere with the service.
- Automate abusive requests, resell access, bulk scrape or redistribute provider datasets, or use Foilport as an unauthorized market-data API.
- Misrepresent an estimated or sample result as a certified grade, authenticated card, guaranteed price, or endorsement by a grading company.
7. Our service, third parties, and trademarks
Foilport’s software, original branding, design, and original demo artwork belong to us or our licensors. We permit you to use the service for its intended purpose while these terms apply. You receive no ownership of the service or licence to redistribute third-party catalog or pricing data beyond what their terms allow.
Pokémon and other card-related names, images, and trademarks belong to their respective rights holders. Foilport is independent and is not affiliated with or endorsed by The Pokémon Company, Nintendo, Creatures, GAME FREAK, or PSA. References to brands or grading criteria describe the cards and tools; they do not imply an official relationship.
Authentication, hosting, AI, market data, and email depend on third-party services. Their availability, coverage, and policies can affect Foilport. External websites and services are governed by their own terms and privacy practices; we do not control them. Our use of processors does not remove obligations that applicable law places on us.
8. Availability, changes, and ending use
We may update, limit, pause, or discontinue beta features, provider coverage, or the service. Checks may be queued, fail, need retakes, or pause when capacity or spending limits are reached. We do not promise an uptime level, response time, recovery time, or support deadline. Where reasonably practicable, we will give notice of a significant service change.
You may stop using Foilport at any time and delete your account through Account or contact us if you cannot access that control. We may suspend or terminate access for a breach of these terms, security or legal reasons, or the end of the beta. Restrictions do not extinguish applicable privacy or consumer rights. Provisions that by their nature apply after use ends, including ownership and lawful liability limits, continue to apply.
9. No warranties to the extent permitted by law
To the maximum extent permitted by applicable law, Foilport and its content are provided “as is” and “as available,” without express, implied, or statutory warranties or conditions, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, or availability.
We do not warrant that the service will be uninterrupted, error-free, free from harmful components, or suitable for a particular transaction; that every defect will be detected or corrected; that a photo estimate will match a professional grade; or that a market reference or collection total will reflect an achievable sale price. No statement here excludes a warranty, condition, duty, or remedy that cannot lawfully be excluded.
10. Limits of liability and your legal rights
To the maximum extent permitted by applicable law, 15507120 Canada Inc. and its directors, officers, employees, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or loss of profit, revenue, business opportunity, anticipated savings, goodwill, or data arising from use of or inability to use Foilport, including reliance on an identification, estimate, price, or collection total. This exclusion applies regardless of the legal basis of the claim, including contract or negligence, even if the possibility of the loss was disclosed.
To the extent permitted by applicable law, we are not responsible for trading losses, grading or shipping fees, physical damage to cards, or other losses resulting from your independent decisions based on estimates or market references, or from third-party services outside our control. This does not exclude liability for losses for which applicable law makes us responsible.
Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence where it cannot lawfully be limited, or any liability, statutory duty, consumer protection, privacy right, warranty, or remedy that applicable law does not permit us to exclude or limit. Where an exclusion is prohibited, it applies only to the extent legally permitted. These terms do not guarantee that all liability is excluded and do not require you to waive non-waivable rights.
11. Applicable law, updates, and general terms
This agreement is subject to applicable Canadian law and any mandatory protections that apply where you live. Nothing here requires arbitration, prevents a complaint to a regulator, or removes a court or remedy that applicable law makes available to you.
We may revise these terms and will display the effective date of the current version. Material changes will be brought to your attention, and renewed agreement will be requested where required by law. Changes do not retroactively remove rights relating to earlier events. If you do not agree to revised terms, stop using the affected service and contact us about your records.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive it. These terms and any express terms presented for a particular feature form the agreement for using Foilport; the Privacy Policy remains a description of our privacy practices and your rights.
